Lasting Powers Of Attorney
We’re here to help you put the right protections in place with a Lasting Power of Attorney (LPA). An LPA is a legal document which allows you to appoint one or more people to make decisions on your behalf during your lifetime. It’s a simple way to make sure your health, welfare, and financial decisions are placed in trusted hands if there ever comes a time when you are unable to make the decisions for yourself.

- If no LPA is in place, the Court of Protection will have to appoint a Deputyship which can be a long, costly and uncertain process.
There are two types of Lasting Power of Attorney documents: Property and Financial Affairs, and Health and Welfare.
- Property and Financial Affairs –A Property and Financial Affairs Lasting Power of Attorney allows you to name Attorneys to make decisions about how your property and money is managed. This can include paying bills, managing bank accounts and investments, collecting income or inheritance due to you, selling property, or managing any business interests you may have in England and Wales. You can elect for this LPA to be valid as soon as it is registered with the Office of the Public Guardian or only when the donor lacks capacity, the choice is yours.
- Health & Welfare - A Health and Welfare Lasting Power of Attorney (LPA) allows you to name Attorneys to make decisions about your personal welfare if you lose the ability to make those decisions yourself. This can include decisions about your healthcare, medical treatment, and even your day to day living arrangements. Unlike the Property and Financial Affairs LPA, this document will only become effective if you lack the mental capacity to make decisions for yourself.

Will storage can be arranged through the National Will Archive for a small annual or lifetime fee, giving you an easy and reassuring way to keep your documents safe. You’ll receive a Certificate of Safe Custody along with two retrieval cards, which you can pass on to your executors, trustees, or attorneys so they know exactly who to contact when the time comes to access your documents.
For added peace of mind, every Will stored with the National Will Archive is automatically registered—free of charge—with The National Will Register. This helps ensure your Will can be located quickly and reliably when it’s needed most.

What happens if I don’t make a Will?
Your estate must be distributed according to the rules of intestacy. This means that your estate may not pass to who you would want it to.
Can I write my own Will?
Yes, you can. However, caution should be exercised as ambiguous wording or the omission of necessary detail can result in confusion or disputes, thus complicating the administration of your estate. Incorrect execution will invalidate your Will.
What if I don’t have Lasting Powers of Attorney set up?
If you lose capacity, the Court of Protection will appoint a deputy to make decisions on your behalf. This may be a family member or it may be a lawyer or Social Services. An LPA allows you to choose the person who will make decisions for you and have conversations in advance around your wishes.
